How to Choose an Executor for Your Will

When I take instructions from Will clients I take time to advise them of the range of possibilities and steer them away from the presumption that the executor MUST or should be the obvious choice such as a spouse or parent etc. This article will give you ideas on what to consider and how to choose an executor for your Will.

 

Rather the person should (at least) fulfil four bare minimum criteria:

 

1. That they won't fall apart when you pass away - often our nearest fall apart the most.

 

2. That they are capable of handling conflict and managing competing demands and interests of family members

 

3. That they have a fair level of acumen and ability to understand legal, financial and accounting issues at least to a moderate level.

 

4. That they are morally upstanding and decent citizens. They will have full access to your money, the temptation is great for those who have less-than-perfect integrity.

 

Taking into account factors such as their relative age to yours, their location, their work-life balance, their free time, their amiability and a whole range of other factors including their consent also need to be considered.
